These Terms and Conditions will apply when you accept an appointment with a representative of Pomegranate Interiors or agree to commission services (as defined) from them. Before proceeding with the requested services, you should read these Terms and Conditions carefully. If you find yourself unable to agree to them, then you should not use these services. If, however, you agree to them you should contact Pomegranate Interiors to discuss your requirements in more detail and arrange an appointment with a representative from Pomegranate Interiors.

1. General Information

2. Formation of Contract
2.1 A contract will be made directly between the client and Pomegranate Interiors as soon as an appointment has been confirmed or works have been agreed, either in writing or verbally between the client and the representative from Pomegranate Interiors. At this time these Terms and Conditions will be provided and will apply.
2.3 These Terms and Conditions shall override any contrary terms or conditions published in any media by Pomegranate Interiors.
2.4 In consideration of the representative from Pomegranate Interiors, the client agrees to comply with these Terms and Conditions (the Agreement) as set out below.

3. Services Pomegranate Interiors will provide:
3.1 Pomegranate Interiors will provide an initial consultation at an agreed fee.
3.2 During the initial consultation, the representative from Pomegranate Interiors may offer, or the client may request ,additional services.
3.3 The representative from Pomegranate Interiors may offer to sell, and the client may purchase, accessories or supplies or other services during a consultation or additional services
3.4 Following the consultation visit, the consultant will provide a follow-on letter with a checklist of items discussed.
3.5 Additional services requested by the client (such as reports, costings, diagrams, supplier recommendations, etc) will be provided by the representative from Pomegranate Interiors within 2 weeks of the initial consultation, or as agreed during discussions between the representative from Pomegranate Interiors and the client in case additional research is required.

4. Security
4.1 When making an appointment for a representative from Pomegranate Interiors to visit, the client will be asked for a telephone number, which must be a landline at the customer's place of residence.
4.2 Prior to the appointment all telephone numbers may be called to verify the legitimacy of the client's details, and to ensure the safety of the representative from Pomegranate Interiors.
4.3 On arrival at the appointment, the representative from Pomegranate Interiors will provide the client with a business card to verify their authenticity.

5. Cancellation Policy
5.1 The client can cancel the appointment prior to the appointment date without incurring any administration charge, by giving a minimum of 3 working hours notice for appointments within the M25, or 24 hours for long distance appointments.
5.2 The client can make this cancellation by calling the representative from Pomegranate Interiors on the contact numbers provided.
5.2 If the client does not cancel in adequate time, Pomegranate Interiors reserves the right to charge the client a cancellation fee of ?50 per cancellation.
5.3 If the consultation is not re-scheduled and expenses have been incurred by the representative from Pomegranate Interiors e.g. travel, parking, product purchase, research etc. this will also be charged to the client at the full value ? supported by receipts etc.

6. Complaints and Client Feedback
6.1 Any complaints must be received in writing ? either as a letter or by email ? and will be acted upon and a response will be given either by phone or in writing

7. Billing and Payment Policy
7.1 Payment should be made in cash or by cheque with a supporting card,. Cheques to be made payable to Pomegranate Interiors.
7.2 Payment for the initial consultation must be made on the day of the consultation or by invoice if agreed with the representative from Pomegranate Interiors.
7.3 If the client agrees to follow-on services (such as reports, costings, diagrams, supplier recommendations, etc) upfront payments will be made in phases as agreed between the client and the representative from Pomegranate Interiors.
7.4 For all goods or services supplied other than on a cash basis, the following terms and conditions shall be applied:
7.4.1 Payment is due immediately on presentation of invoice unless otherwise agreed and stipulated on the invoice.
7.4.2 If the invoice is despatched by post, payment must be received within the time stipulated from the date of the invoice.
7.4.3 Any queries regarding goods and services supplied, quality, quantity or price related thereto, or work undertaken, must be raised immediately with the representative from Pomegranate Interiors at the time of presentation of invoice. No queries will be entertained after that date.
7.4.4 Interest at the rate of 15% per annum shall be payable on all accounts not paid in full by their due date. This interest will be added from the invoice date.
7.4.5 Should the need arise for Pomegranate Interiors to instruct a debt recovery agency or to instigate legal proceedings, the client will be liable for any costs so incurred.
7.4.6 Cheques are only accepted on the basis of being paid on first presentation. A charge of ?35.00 will be made towards bank and administration charges for each cheque returned unpaid for any reason, whether or not the cheque is honoured on re-presentation.
7.4.7 Ownership of goods and materials supplied shall not pass to the client until Pomegranate Interiors has received in cash or cleared funds the full price of the goods. However, risk of loss or damage to the goods shall be the responsibility of the client upon collecting or taking delivery of the goods.

8.Dates and Completion of works
8.1 Every effort will be made by Pomegranate Interiors to ensure that deadlines are met, however due to the nature of building and decoration projects we can not take responsibility if completion dates are not met.

9. Disclaimer of Liability
9.1 This contract is between the customer and Pomegranate Interiors.
9.2 Pomegranate Interiors is not liable for works carried out by contractors, whether they have been introduced to the client by Pomegranate Interiors or not.
9.3 Pomegranate Interiors is not liable for faults in products supplied through retailers, contractors or other suppliers. However, should a product show fault after installation Pomegranate Interiors will make every reasonable effort to retrieve some compensation on behalf of the client and will forward any monies retrieved.

10. Term & Termination
10.1 This Agreement will become effective as of the date of the client's acceptance of the scheduled appointment or services, either verbally, in writing or via email.
10.2 Pomegranate Interiors reserves the right to terminate this contract and cancel any works without notice at their own discretion. Upfront payments for the uncompleted works will be refunded.
10.3 All works will be terminated with immediate effect if the client treats any member of Pomegranate Interiors staff in an aggressive, threatening or disrespectful manner.
10.4 In the event of termination of contract the client will be liable for outstanding costs of any fees, expenses or products. If monies have been made upfront ,these costs will be taken from these monies and any excess returned.

11. Entire Agreement
11.1 These Terms and Conditions constitute the entire agreement between the customer and Pomegranate Interiors relating to the delivery of services and shall supersede and replace all other contracts, discussions, letters or communications (whether written or oral) relating to the subject matter hereof save that neither party excludes liability for any fraudulent misrepresentations made by it to the other party on which the other party can be shown to have relied.

12. Applicable Law
12.1 The laws of England and Wales will govern the application and interpretation of these Terms and Conditions, and in the event that a dispute arises between the parties, both agree to submit to the exclusive jurisdiction of the English Courts.
12.2 These Terms and Conditions will apply when you accept an appointment with the representative from Pomegranate Interiors or agree to commission services from them. Before proceeding to request these Services, you should have read these Terms and Conditions carefully. If you find yourself unable to agree to them, then you should not use these services. Your statutory rights are not affected.
